<P class=MsoNormal style="MARGIN: 0in 0in 0pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 14pt"><FONT face="Times New Roman">Sáng nay, ngày 13 tháng 11 năm 2009, tôi có đọc bài báo “<B style="mso-bidi-font-weight: normal">Cảnh sát bắt gọn tên cướp giữa đường phố”, </B>của phóng viên Đức Quang<B style="mso-bidi-font-weight: normal"> </B>Trong bài có đoạn viết: “<B style="mso-bidi-font-weight: normal">Là con nghiện nặng, trung bình mỗi ngày “đốt” khoảng 200 nghìn đồng vào ma tuý”.<o:p></o:p></B></FONT></SPAN></P>

<P class=MsoNormal style="MARGIN: 0in 0in 0pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 14pt"><FONT face="Times New Roman">Thứ nhất dùng từ “<B style="mso-bidi-font-weight: normal">Con nghiện”</B> và “<B style="mso-bidi-font-weight: normal">đi tìm mồi</B>” là hết sức<SPAN style="mso-spacerun: yes"> </SPAN>miệt thị. Cũng có thể coi người sử dụng ma tuý là một bệnh. Nghe có vẻ giống như “<B style="mso-bidi-font-weight: normal">một con thú đi tìm mối” </B>Trong thời gian chưa được xét xử thì nhân vật trong bài báo chưa được coi là có tội. Hơn nữa, tội phạm tuy có mất quyền công dân nhưng họ vẫn có quyền con người.<o:p></o:p></FONT></SPAN></P>

<P class=MsoNormal style="MARGIN: 0in 0in 0pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 14pt"><FONT face="Times New Roman">Thứ hai, khi chưa được sự đồng ý chưa được công khai tên, tuổi,<SPAN style="mso-spacerun: yes"> </SPAN>hình ảnh của người có HIV lên mặt báo là vi phạm Luật phòng, chống HIV/AIDS. Điều 8, khoản 5 “<B style="mso-bidi-font-weight: normal">Nghiêm cấm công khai, địa chỉ, tên tuổi của người nhiễm HIV hoặc cho người khác biết về một người nhiễm HIV, khi chưa được sự đồng ý của người đó”.<o:p></o:p></B></FONT></SPAN></P>

<P class=MsoNormal style="MARGIN: 0in 0in 0pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 14pt"><FONT face="Times New Roman">Thứ ba, Tình trạng nhiễm HIV không phải yếu tố cấu thành tội phạm đựợc quy định trong Luật hình sự, cũng không được coi là tình tiết tăng nặng hay giảm nhẹ. Trong đó, có 4 yếu tố. “<B style="mso-bidi-font-weight: normal">Khách thể, chủ thểt, khách quan và chủ quan”. </B>Có thể anh ta cần tiền mau ma tuý nên đã phạm tội nhưng nếu không có HIV thì anh ta vẫn phạm tội. Việc đồng hoá HIV với tội phạm là không cần thiết.<o:p></o:p></FONT></SPAN></P>

<P class=MsoNormal style="MARGIN: 0in 0in 0pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 14pt"><FONT face="Times New Roman">Cuối cùng là, phóng viên Đức Quang dùng từ hết sức phản cảm đi ngược với chủ trương chống kỳ thị và phân biệt đối xử với người có HIV của nhà nước. Không những thế còn tạo ra sự hiểu lầm không đáng có và gây khó khăn cho hoạt động phòng, chống HIV chúng tôi đang làm. <o:p></o:p></FONT></SPAN></P>

Sắp kỷ niệm ngày “<B style="mso-bidi-font-weight: normal">Thế giới phòng, chống HIV/AIDS”,</B> 01 tháng 12. Đáng lẽ VNXPRESS nên có những bài tích cực hơn về người có HIV.<o:p></o:p></FONT></SPAN></P>
