Consultancy Services to Produce a clip:

the role of Better Work in supporting effective due diligence for the factories

Duration: December 2023 – February 2024

1. Background:

Better Work is an innovative partnership program between the International Labour Organization (ILO) and the International Finance Corporation (IFC) dedicated to enhancing labor standards and global supply chain competitiveness. The initiative encompasses the development of both global tools and country-level programs, with a key focus on scalable and sustainable solutions that foster collaboration among government agencies, employers, workers' organizations, and international brands. In Viet Nam, Better Work Viet Nam (BWV) covers the garment and footwear industries, employing an integrated approach that encompasses assessment, advisory, and training services at the factory level. Our collaboration extends to diverse stakeholders, including MOLISA, VGCL, VCCI, international brands, vendors, factories, trade associations, and other relevant organizations within the apparel and footwear sectors.

On September 13, 2022, the Japanese Government issued corporate human rights due diligence guidelines. These guidelines emphasize that every business, regardless of its scale, is obligated to uphold human rights. This entails addressing both current and potential negative impacts on human rights associated with their operations, whether within or outside the borders of Japan. Additionally, in February 2023, the European Commission (EC) issued a directive on corporate sustainability and due diligence. Due diligence is a process that allows businesses to identify, prevent, mitigate and account for how they address actual and potential adverse impacts of their operations and business relations on people and the planet. The directive requires EU member states to create laws that monitor environmental, social, and governance (ESG) issues in their global supply chains.

In the context of Viet Nam, the Prime Minister has issued Decision No. 681/QD-TTg, endorsing the Roadmap for the implementation of Viet Nam's sustainable development goals until 2030. Notably, this Roadmap sets out 119 targets designed to track advancements toward attaining the United Nations' Sustainable Development Goals. These objectives include environmental, human rights, and labor rights targets.

Recently, Viet Nam has introduced a Corporate Sustainability Index that evaluates businesses according to various essential sustainability criteria. In 2022, 130 indicators were employed to assess the sustainability of participants. These criteria were formulated in alignment with the Labor Law, Environmental Law, Viet Nam's commitments at COP21 and COP26, the Global Reporting Initiative, and ISO 26000 standards. Additionally, a diverse set of Environmental, Social, and Governance (ESG) requirements embedded in Viet Nam's various free trade agreements were considered. As the result, Vietnamese businesses looking to attract foreign capital and expertise will find themselves more appealing by embracing sustainable practices.

For ILO/Better Work Viet Nam programme, due diligence expectations are included in the key international frameworks: (i) the ILO Tripartite Declaration of Principles concerning Multinational Enterprises and Social Policy (MNE Declaration); (ii) the United Nations Guiding Principles on Business and Human Rights and (iii) the OECD Guidelines for Multinational Enterprises. MNE Declaration is the ILO instrument that provides direct guidance to enterprises on social policy and inclusive, responsible and sustainable workplace practices.

Given the recent surge in supply chain sustainability regulations, businesses operating in Vietnam must ensure compliance to legal frameworks across their operations, subsidiaries, and the entire value chain, including suppliers. While compliance with due diligence laws presents challenges such as increased costs and implementation, early adherence is crucial to mitigate the risk of supply chain exclusion. Businesses are now required to evaluate region and industry-specific risks and conduct sustainability analyses. Foreign firms in Viet Nam may also need to conduct due diligence and compliance checks to ensure their suppliers meet these new standards.

To visually depict BWV's approach and emphasize the program's role in facilitating effective due diligence for participating factories, encouraging the adoption of sustainable practices, we are actively seeking a consultant or company to produce a short film. The video clip targeted to be around 5 minutes in duration.
