The United States Agency for International Development (USAID) Saving Species Program is USAID/Vietnam’s flagship implementation vehicle for combating wildlife trafficking and implemented by Tetra Tech in partnership with Vietnam CITES Management Authority of the Ministry of Agriculture and Rural Development. TRAFFIC Vietnam and the Wildlife Conservation Society (WCS) are also project partners.

USAID Saving Species is seeking up to 5 qualified Consultants to support the development of a draft Decree “On the management of precious, rare and endangered wild fauna and flora; captive breeding, rearing normal forest animals and the implementation of the Convention on International Trade in Endangered Species of Wild Fauna and Flora” (CITES Decree)

Below is the summary of the SOW. For more details, please refer to the attached SOW.

Overall Goal

To support the development of a draft CITES Decree to submit to the GVN for promulgation. The draft Decree focuses on 4 main areas as follows:

  • Exploitation and conservation of rare, precious and endangered wild fauna and flora and endangered wild fauna and flora listed in CITES Appendices;
  • Captive breeding, rearing and artificial propagation of wild fauna and flora as well as species listed in CITES Appendices.
  • Export, import, re-export, transit of specimens of rare, precious and endangered wild fauna and flora and specimens of endangered wild fauna and flora listed in CITES Appendices.
  • Functions and tasks of CITES MA of Vietnam and inter-agency coordination mechanisms in preventing and combating illegal trade of wild fauna and flora.

Objectives

  • Abolish overlapping, conflicting and illegal regulations on management and protection of precious, rare and endangered wild species and CITES implementation
  • Revise regulations which are not in line with present reality;
  • Supplement new regulations to comply with the law and current practice.

Main tasks & Responsibilities:

  • Review legal provisions, assess the implementation of legal regulations in reality, and propose recommendations for amendments / supplements;
  • Participate in the development of a list of endangered, precious and rare forest fauna and flora species;
  • Develop a draft CITES Decree;
  • Develop Report on feedback consolidation and response on the draft CITES Decree;
  • Prepare presentations, attend and deliver explanations at Technical Meetings;
  • Contribute to the Report on impact assessment of administrative procedures prescribed in the draft CITES Decree.
  • Contribute to the draft Proposal proposing the promulgation of the draft CITES Decree
  • Work/ collaborate closely with each other in a Team led by a Team leader

Timeline/Working days

Starting date: 1st August 2018.

Ending date: When MARD submits the draft CITES Decree to GVN for consideration and promulgation (expected date 31st October 2018).

Total working time for conducting the consultancy work: 312 days (8 hours per day).

  • The working time of each of the Consultant(s) incharge of contents1,2,3,4 is 60.5 days
  • The working time of the Team leader is 70 days.

Qualifications/Criteria

  • Bachelor degrees or higher and at least 10 years of working experience in the relevant areas;
  • Knowledge and capacity specialized in the 4 areas of the CITES Decree, in the fields such as Biology, Forestry, Veterinary, Law etc.
  • Experience in conducting similar tasks;
  • Experience in development of Legal Normative Documents: Law, Decree, Circular, etc.
  • Experience in working with state management agencies at all levels;
  • Experience and skills in teamwork; Ability to analyze, synthesize reports, synthesize and analyze law and policy issues;
  • Writing legal documents skill;
  • Presentation skills;
  • Office computer skills;
  • The candidate selected as the team leader must possess demonstrated extensive experience in legislation drafting in Vietnam and have demonstrated team leadership experience and skills.

Application method

Option 1: Applicants apply individually for Consultant(s) incharge of contents 1,2,3,4 and Team leader separately.

The successful candidates (up to 5 Consultants) then shall together work in a team to take responsibilities and fulfill tasks, to achieve the Overall Goal and Objectives of the Consultancy Service.

Option 2: Applicants will team up consisting of up to 5 consultants to apply for the whole consultancy work.
