#VN003 - Job Title: International STC on health legislation

1. Background:

In the upcoming years, Viet Nam plans to develop and revise several major health laws, including the Law on Examination and Treatment, Social Health Insurance Law, Pharmaceutical Law, Law on Medical Devices, and Population Law. In January 2023, the National Assembly will hold an extraordinary session to have a third hearing on the revision of the Law on Medical Examination and Treatment (LET). Following this Law, many decrees and circulars will be developed to further outline the implementing rules and regulations regarding regulation of the health workforce, health facility, and other issues. In addition, the revisions of the Social Health Insurance (SHI), Population, Road Traffic Safety, and Pharmaceutical Laws are expected to be reviewed by the National Assembly in 2023. With the ongoing health sector reforms and lessons from the COVID-19 outbreak, it is a critical time to review and revise these major health laws to shape the health system to support the long-term vision.

The Ministry of Health has requested the WHO Representative Office in Viet Nam to continue providing technical assistance to the Government of Viet Nam in health legislation, including development and revision processes and subsequent implementing rules and regulations.

2. Work to be performed

Method(s) to carry out the activity

The consultant can work remotely if needed. The work will involve but not be limited to; coordinating across Ministry of Health and partners, participating in meetings and workshops (remotely if needed), providing technical advice to documents and reports as required. The consultant will provide support to the UHC team and relevant MOH departments on health legislation.

Output/s

Under the overall supervision of the UHC-HLE Team Coordinator, the consultant will support the UHC team and other teams as needed on the following outputs:

  • Output 1. Technical support provided to the revisions for major health laws, including Law on Examination and Treatment, Social Health Insurance, and Population Law
    • Deliverable 1.1. Briefing note on international legislation practices related to implementing rules and regulations, such as decrees and circulars, following the Law on Examination and Treatment revision
    • Deliverable 1.2. Briefing notes with international legislation practices on key discussion topics related to the Social Health Insurance Law revision
    • Deliverable 1.3. Briefing notes with international legislation practices on key discussion topics related to the Population Law revision
  • Output 2. Technical support provided to health sector reform in Viet Nam in the area of food, drug, and vaccine regulatory systems
    • Deliverable 2.1. Briefing notes with international legislation practices on key discussion topics related to the revision of the Pharmaceutical Law
    • Deliverable 2.2. Substantive technical input provided to development of the food, drug, medical devices, and vaccine regulatory system, including for COVID-19 therapeutics and vaccines
  • Output 3. Technical support provided to the Law on Road Traffic Safety
    • Deliverable 3.1. Briefing notes with international legislation practices on key discussion topics related to the Law on Road Traffic Safety

3. Planned timelines (subject to confirmation)

Start date: 1 Feb 2023
End date: 31 Dec 2023

The short-term consultancy may be supported by more than one consultant depending on the relevant expertise and experience of the consultant in relation to the various legislation.

4. Specific requirements

a. Qualifications required:

  • Essential: Undergraduate degree in relevant areas including health legislation, public administration, or public health
  • Desirable: Master’s degree in relevant areas including health legislation, public administration, or public health

b. Experience required:

  • Essential: At least 2 years of experience in relevant areas including health legislation and health policy development
  • Desirable: Prior experience of working with the Government of Viet Nam or in the Western Pacific Region in health legislation will be considered an advantage.

c. Skills / Technical skills and knowledge:

  • Strong analytical and communication skills
  • Ability to write
  • Knowledge of the health system in Viet Nam desirable
  • Specific technical knowledge with health legislation process in Viet Nam is desirable

d. Language requirements:

  • Expert written and spoken English

e. Competencies

5. Place of assignment

Under the guidance of the UHC-HLE Team Coordinator and relevant technical staff, the consultant will be based off-site.

6. Medical clearance

A fitness of work clearance will be required, including for off-site consultants.

7. Travel

If remotely based, the consultant may be expected to have duty travel missions to Hanoi, Viet Nam for 1 – 2 months duration depending on requirements.

8. Budget
