Title: National Experts to develop the regulations on environmental industry in the Guiding Decree to the Law on Environmental Protection 2020 in Viet Nam

Location: mostly home-based, travelling within Hanoi may be required

1. CONTEXT

The Hanns Seidel Foundation is a political foundation with its headquarters in Munich (Germany). “In the service of democracy, peace and development” – this motto is present in the work and mission of the Hanns Seidel Foundation. This motto applies both to its activities in Germany and abroad. Since 1995, HSF has supported the integration of Vietnam into the global political spectrum and the ASEAN-Community. Since the establishment of a representative office in 2011, HSF has focused its work in Vietnam on social and environmental policies for sustainable development.

Among the long-standing partners of HSF is the Institute of Strategy and Policies on Natural Resources and Environment (ISPONRE), the think-tank under the Ministry of Natural Resources and Environment (MoNRE) of the Socialist Republic of Vietnam. As the key policy advisory agency to the Ministry, ISPONRE has been assigned to be responsible for several topics in the Guiding Decree to the Law on Environmental Protection 2020 including the regulations on developing the environmental industry.

The environmental industry is an integral part of the Vietnam’s sectoral economic system and will be crucial in the process of making production patterns and service delivery in Vietnam more sustainable. The environmental industry of Vietnam has an average annual growth rate of over 15% due to the high demand for pollution treatment and environmental equipment in the context of continuous economic. In Febuary 2017, the Prime Minister issued Decision No. 192/QD-TTg on “A scheme for developing Vietnam’s environment industry by 2025”. Most recently, Article 143 of the Law on Environmental Protection 2020 sets out the government’s commitment to invest in and adopt policies to support the development of the environmental industry.

To support ISPONRE in drafting the detailed regulation on environmental industry in the decree to the Law on Environmental Protection 2020, HSF and ISPONRE have agreed to jointly identify TWO national experts. The national experts will work closely with an international expert (to be identified in a separate ToR) and the ISPONRE research team to produce a background research paper and to propose the regulations on environmental industry on the Guiding Decree to the Law on Environmental Protection 2020.

2. OBJECTIVE(S)

The main objectives of this assignment are as follows:

  • Review the status quo of environmental industry in Vietnam including policies, regulations, and type of environmental goods and services,
  • To identify a list of technologies, equipments, products, services and projects of the environmental industry sector and provide inputs for policies on the opening of a market for environmental goods & services.
  • To assist ISPONRE in proposing a draft policy on environmental industry sector that will be utilized in drafting the Decree guiding the implementation of the Law on Environmental Protection 2020 in Vietnam;

3. TASKS & DELIVERABLES

3.1 Detailed tasks

Together with an international expert, the two selected consultants, hereinafter refered to as the Expert A and the Expert B, will perform the following tasks:

a. The Expert A:

  • Review Vietnam’s current legal system comprising regulations, policies on investment and support to the development of environmental industry and market for environmental goods & services;
  • Analyse requirements, advantages and drawbacks of current regulations to promote the development of environmental industry sector in Vietnam;
  • Conduct in-depth expert meetings with relevant experts and stakeholders for collecting comments to finalize the regulations on the environmental industry to be included in the Guiding Decree;
  • Discuss with the international expert to determine suitable policies to enhance the development of environmental industry in Vietnam in the Guiding Decree of LEP 2020;
  • Prepare and coordinate with Expert B in drafting the final report.

b. The Expert B:

  • Review the current equipments, products, services, technologies and projects related to the environmental industry sector in Vietnam;
  • Research and developing criteria and characteristics of the identification of equipments, products, technologies, services and projects related to the environmental industry sector in Vietnam;
  • Provide a list of equipments, products, technologies and types of projects related to the environmental industry sector in Vietnam;
  • Conduct in-depth expert meetings with relevant experts for collecting comments to finalize the regulations on the environmental industry to be included in the Guiding Decree;
  • Work closely with the international expert to determine the list of products, services, technologies and projects in the environmental industry sector to mainstream international best practices in the Guiding Decree;
  • Propose regulations on environmental industry in the Guiding Decree of LEP 2020 including:
    • list of technologies, services and goods to be defined as environmental industry; types of
    • projects referred to environmental industry;
  • Prepare and coordinate with Expert A in drafting the final report.

3.2 Deliverables

The national consultants are expected to submit the following deliverables:

3.2.1 For Expert A

  • 1 sub-report comprising:
    • Review Vietnam’s current legal system being relevant to the development of environmental industry and markets for environmental goods;
    • Propose investment support policy on the development of environmental industry in Vietnam;
    • Policy recommendations on the opening of a market for environmental goods and services;
  • Tailor-made presentations for consultative meetings and consultative workshops.

3.2.2 For Expert B

  • 1 sub-report which is composed of:
    • Criterias, characteristics of the identification of equipments, products, technologies, and projects reffered to environmental industry sector in Vietnam
    • Proposals to the Guiding decree of LEP 2020 including: list of equipments, products, technologies, and projects refered to environmental industry in Vietnam
  • Tailor-made presentations for consultative meetings and consultative workshops

3.2.3 For both national experts:

  • 1 Joint Final synthesis Report comprising policy recommendations to support the development of environmental industry in Vietnam and a specific list of equipments, products, services, technologies and projects reffered to environmental industry in Vietnam.
  • 1 proposal on the provisions for the development of environmental industry and recommendations for the implementation of policies in the Guiding Decree of the revised Law on Environment Protection 2020.

All deliverables are to be produced in Vietnamese with an Executive Summary in English.

4. SCOPE, TIMELINE and REMUNERATION PACKAGE

  • The contract covers a maximum of 40 full working days for expert A and 25 full working days for expert B.
  • Renumeration is subject to qualifications and experience but capped to a maximum of 220 USD per day.
  • The contract duration is from August to November 2021.
  • The workload will vary significantly across the contract duration.
  • Payment will be made in 2 milestones and upon acceptance of deliverables.

5. QUALIFICATIONS AND EXPERIENCE REQUIREMENTS

5.1 For Expert A:

Education:

  • Minimum a Master’s degree in environmental economics, environmental management, environmental policy development or related field. A PhD is an asset but not required.

Experience and Skills:

  • Minimum 15-years experience working in development of environmental policy at a senior level.
  • Minimum 10-years experience in consultancies and/or other assignments related to projects on environmental industry, environmental economy, sustainable development, trade and environment policy development.
  • Sound knowledge of environmental protection requirements & administrative procedures in Viet Nam.
  • Excellent professional network in key public, private and non-governmental sectors dealing with the environmental industry.
  • Experience working in international donor-funded projects is an advantage.

Language:

  • Good oral and written communication skills in both Vietnamese and English.

Other skills:

  • Adequate digital/software literacy and skills necessary to complete assignments.
  • Good interpersonal and presentation skills

5.2 For Expert B:

Education:

  • Minimum of Master’s degree in environmental technology, environmental management, environmental engineering, or related field. A PhD is an asset but not required .

Experience and Skills:

  • Minimum 10-years experience working in environmental pollution control, environmental and pollution control equipments, environmental pollution treatment, measures to reduce pollution, etc.
  • Minimum 7-years experience in consultancies and/or other assignments related to projects on environmental industry, environmental economy, , environmental pollution treatment, measures to reduce pollution and environment policy development.
  • Sound knowledge of environmental protection requirements & administrative procedures in Viet Nam.
  • Excellent professional network in key public, private and non-governmental sectors dealing with the environmental industry
  • Experience working in international donor-funded projects is an advantage.

Language:

  • Good oral and written communication skills in both Vietnamese and English.

Other skills:

  • Adequate digital/software literacy and skills necessary to complete assignments.
  • Good interpersonal and presentation skills
