TERMS OF REFERENCE

Position: Short-term consultancy on providing comment to curriculum “The activities of people's procuracy in handling with wildlife cases”
Report to: Capacity Building Manager
Location(s): Viet Nam

I. BACKGROUND

The Wildlife Conservation Society (WCS) is a US non-profit, tax-exempt, private organization established in 1895 that saves wildlife and wild places by understanding critical issues, crafting science-based solutions, and taking conservation actions that benefit nature and humanity. WCS has been working in Viet Nam since early 2006 to strengthen the commitment and capacity of the Vietnamese government to combat wildlife trafficking.

The Hanoi Procuratorate University (HPU) is the primary body that trains future prosecutors and also carries out ongoing training for prosecutors in service. In the framework of project implementation, WCS will support HPU to develop and institutionalize an elective course module about activities of people’s procuracy in handling with wildlife cases. This course aims to provide knowledge and skill on wildlife trafficking situation, legal framework relates to this sector, responsibility of people’s procuracy and best practices to HPU’s students. One of the activity’s products is training curriculum would be developed and approved according to HPU’s procedure, that is a process includes at least 4 rounds of comment, appraisal and approval.

II. SCOPE OF WORK

Providing comment on the curriculum “The activities of people's procuracy in handling with wildlife cases”

III. ACTIVITIES

The consultants will implement below activities in two rounds of the comment, appraisal and approval process:

1. Providing comment and recommendation on the curriculum. Detail information of the material as below:

• Name: Roles of People’s Procuracy in dealing with wildlife related cases
• Structure: 116 pages, including 6 chapters:
  
  • Chapter 1: Overview of wildlife and wildlife conservation
  • Chapter 2: International and national legal framework on management and protection of wildlife
  • Chapter 3: Theoretical foundation on activities of the People’s Procuracy in dealing with wildlife related cases
  • Chapter 4: Activities of People’s Procuracy in investigation, legal proceedings against a case and person relating to wildlife crime cases
  • Chapter 5: Activities of People’s Procuracy in prosecution of wildlife crime cases
  • Chapter 6: Activities of People’s Procuracy in conviction of wildlife crime cases

2. Attending and involving in discussion session of the consultation meeting with expert of HPU and other institute/agency, and appraisal meeting. The meeting is tentatively planned in October - November 2019.

IV. REQUIREMENTS

The Consultants need to be satisfied criteria as below:

• Be Vietnamese;
• Having a master degree or higher in law or related majors;
• Having at least 5 years of experience in training, developing training program/curriculum, working for procuracy agency.

V. PROFESSIONAL FEE AND EXPENSES

Professional fee and other expenses (travel, accommodation, per-diem, if any) within the scope of the service shall be based on the consultant’s proposal in accordance with WCS’s cost norms and activity’s budget.
