[ingodirectors] Update on Decree 12 Revision 22 July 2019 + Draft 04 of D12 Revision

Dear INGO directors:

On behalf of the INGO Task Force for the revision of Decree 12, I
would like to share an update on the latest developments in the
process. I would also like to circulate the 4th version of D12
revision, together with comments from our consultant Dr. Giao. Both
documents are only available in Vietnamese. An English translation of
this draft would not have been beneficial since the final decision is
in the Government's hands now. We did our best by submitting three
sets of INGO recommendations in October 2017; February 2018; and
December 2018 (all available upon request). According to the Ministry
of Foreign Affairs, although there may be some minor re-wording, this
is "almost-final" version before submitting it to the Government for
approval.

In short, there are some improvements, compared to the original Decree 12:

a) more detailed time frames for feedback on INGOs' requests to
register operations; representative offices; or renew existing
registrations;
b) options for INGOs to do fundraising from international individuals
and organisations within Vietnam, for development / aid purposes only;
c) establishing an online database system for INGOs;
d) an option for INGOs' regional representative offices in Vietnam

There are some less positive news as well. One of the most significant
INGOs' suggestion was a request to allow them to work nation-wide,
without listing all names of provinces in INGOs' registration
applications in advance. This would have saved tremendous amount of
time, paperwork and labour -- every time INGOs decide to expand to new
provinces. Unfortunately, this recommendation was not accepted. Also,
COMINGO is not mentioned in the 4th draft, therefore VUFO will no
longer be a focal point for INGOs. It is not clear if PACCOM will
continue to serve as the main point of contact for INGOs; and -if yes-
under which agency.

The Task Force and I will keep you informed of any news as they develop.

Please see attached the Final Comments on the 2nd Draft of Decree 12
Revision that will be submitted to the Drafting Committee at the
Ministry of Foreign Affairs next week. I also attached the 2nd draft
document for your reference.

Let me know by 5:00 PM next Monday, 17 December, if you would like to
add your organisation's name to the list of supporters.

The current supporters listed at the end of the attached document were
included based on the list of INGOs who supported the previous
comments on the 1st draft of Decree 12 revision. Those of you who
would like to be removed from the list, kindly let me know before
Monday COB.

The final comments are based on the consultations held on 24 October
2018, organised by the INGO D12 task force, with a large group of
interested INGOs, as well as individual comments submitted
electronically afterwards.
