[opportunities] CARE: Legal Analysis Consultant for Enhancing Women's Voice to Stop Sexual Harassment

Dear All,

Care International in Vietnam is seeking for Legal Analysis Consultant candidate for Enhancing Women's Voice to Stop Sexual Harassment.

The legal analysis is expected to cover the legal and regulatory environment:

1.       Provide an overview of the national legal framework in Vietnam in relation to prevention and response to sexual harassment  both inside and outside the workplace, with a particular focus on garment factories.

2.       Identify and describe all relevant legal instruments and their operational mechanics, including compliance mechanisms (such as inspections), redress/ complaints mechanisms both individual and collective (through courts or tribunals) and criminal proceedings (if relevant).

3.       Identify factors and key stakeholders that influence law and policy making and implementation on sexual harassment, particular in garment workplace.

4.       Identify and describe all relevant Government programs that are operating to support implementation of the laws.

5.       Examine the effectiveness of enforcement and implementation of laws and policies in workplace, particular garment factories in practice, including good practical models of preventing and responding sexual harassment at garment workplaces;  and identify gaps in enforcement and implementation.

6.       Identify the gaps between local law and policies and international labour standards in relation to sexual harassment and gender based violence.

7.       Develop recommendations:

*         to improve laws to inform future legal reform in line with international standards

*         to  improve implementation and enforcement of existing law and policies and

*         to inform the development of practical workplace policies to provide protections for women in the workplace.
