LEGAL ADVISOR ON LAND RENTAL – SOCODEVI (VIETNAM)
BACK GROUND INFORMATION
SOCODEVI is a Canadian network of cooperative and mutual assistance enterprises which shares its technical expertise and know-how with its partners in developing countries. SOCODEVI office in Vietnam requires the services on legal advisor on land rental to support Don Duong Coop in the land rental process within the framework of Specific Agreement 2019 signed between Don Duong Coop and the Cooperative Enterprise Development Project (VCED).
VCED Project have planned to support Don Duong Coop to construct a hi-tech farm in Don Duong District, Lam Dong Province, and this planning with estimate cost have been indicted in the Specific Agreement 2019 signed between Don Duong Coop and VCED Project. One of the conditions to implement the construction is that Don Duong Coop must use its own resource to rent a slot of land with the area of 3 ha.
PRINCIPAL RESPONSIBILITIES
Under the coordination of the project managers, and Vietnamese Law Framework, the legal advisor will be responsible for recommendations on necessary procedures and related cost regulated by the Government’s Policies when renting land. He/she will also oversee the implementation schedule of this land rental task in order that related stakeholders could prepare legal documents promptly to speed up the rental process.
SPECIFIC FUNCTIONS:
- To review the legal regulation of Vietnamese Law and Policies in land rental; especially articles related to Coop’s authorization (if applicable);
- To check the legal status/ land use right of the land which is targeted for this rental contract;
- To provide guidance and recommendation to the Dong Duong Coop and VCED project on legal documents which are in needs for the rental process, for example checking the legal status of land intend to be rented, rental strategies/condition in order to maximize the long-term benefits of Coops in rental process;
- To facilitate the process for signing the land-rental contract between Don Duong Coop and the landlord, including to draft the rental contract, to assist the Coop and VCED in negotiating the contract conditions/ articles with the landlord, and to finalize the contract based on the comments of related stakeholders
EDUCATION
- Graduate in the areas of laws
- Asset: understanding of one of Canada’s two official languages (English/French)
EXPERIENCE
- At least five years’ work experiences in legal advices
- Good understanding of Vietnamese Laws, Policies’ context.
- Excellent skills and capacity on contract negotiation
- Excellent oral and written communication skills for both English and Vietnamese
- Manage multiple-culture working styles.
- Capacity to analyze and synthesize
- Excellent skills in managing priorities and capacity to work on several outputs simultaneously, as well as facility for team work
