1. Justification
Center for Women and Development, CWD, is part of Vietnam promoting women’s development nationwide, especially women of vulnerable groups and from difficult backgrounds.
Recognizing the importance of safe shelters for the process of recovery and reintegration of identified survivors of human trafficking, CWD, with the support of the Spanish Agency for International Development Cooperation, AECID, established in 2007 the Peace House Shelter Project supporting victims of trafficking in persons, PHSP. Until now, the PHSP has provided comprehensive support and assistance to more than 280 women and girls survivors of Human Trafficking, and more than 3000 cases have been handled and referred by its counseling room.
The comprehensive needs-based support package offered by the Peace House Shelter, PHS, includes safe accommodation, medical and psychological care, legal aid, education, entertainment activities, life skills training, vocational training, job placement, and reintegration support. This approach aims at ensuring an appropriate assistance, preventing the re-victimization of survivors by empowering them to regain control over their lives and decisions.
CWD has recognized the need to strengthen the capacity and knowledge of the PHS staff in regards to human trafficking legislation and other relevant laws to improve legal counseling and legal information provision to residents of the PHS.
2. Objectives of the assignment
To provide relevant legal information, in the framework of the Vietnamese law and international conventions, related to human trafficking survivors in order to improve the legal counseling and information provision services at the Peace House Shelter, PHS, which provides recovery and reintegration services to human trafficking survivors.
3. Expected results
- Shelter’s staff understand the legal issues regarding human trafficking survivors laws concerning residents of the PHS
- Shelter’s staff understand the different steps to be taken according to the different legal procedures
- Shelter’s staff is aware of the different institutions or departments at central and provincial level to refer to when needing further information
4. Content of training
Content of training should include, but not limited, to:
- Relevant legislation on Human Trafficking (i.e rights and responsibilities, legal status, personal documentation, etc).
- Relevant legislation on Domestic Violence
- Prosecution options to human trafficking survivors: rights and responsibilities within the framework of legal proceedings, different options, how to claim, procedures to follow, entity/agency/department/person responsible in the different stages of the procedures, government support during the trial process, compensation issues to survivors, etc.
- Relevant legislation regarding minors
- Relevant legislation related to ethnic minorities
- Relevant legislation on family and marriage (age for marriage, divorce, child custody, obtaining birth certificate, double marriage (i.e what happens when married in VN and in another country due to trafficking); differences applied to ethnic minorities, etc)
- Relevant legislation related to labour issues (i.e working age, working possibilities according to age, discriminatory issue, etc)
- Miscellaneous issues affecting human trafficking survivors such as land ownership
- Overview of Government support to survivors of Human Trafficking at central and provincial level.
- Provide information on the different public agencies/departments/centres that can provide further information according to the different issues (i.e legal aid centres at provincial level, etc).
5. Methodology
The trainer will provide the knowledge and skills needed to the participants in order to achieve the expected results mentioned in point 2.
The methodology to be used includes pro-active and dynamic methods of teaching combine with case studies applicable to the PHS and, referring to legal questions regarding ‘what if’ scenarios to legal counseling.
6. Calendar
Training will be conducted in 3-4 days within the first half of September 2014
7. Deliverables
- Final report on the achievements of the expected results and the assessment of the knowledge improvement will be submitted to PMU within 1 month from the end of the training.
- Written document with the legal information provided during the training and relevant contacts to be used by the PHS staff in their daily work will be provided to the PHS staff and submitted to PMU within 10 days from the end of the training.
- Debriefing with Project Management Unit after the end of the training.
8. Requirements
- University degree in law
- Extensive experience in providing training on Vietnamese legislation regarding human trafficking
- Substantive knowledge in civil Vietnamese legislation
- Relevant experience in facing practical legal concerns related to human trafficking survivors and/or vulnerable groups.
- Technical competence and experience in using adult training methods
- Fluency in Vietnamese. English knowledge will be valued.
- Ability to work respectfully, confidentially, independently, with a sense of humor and collaboratively

Technical proposal will include, at least, proposed agenda, experience and CV in English and Vietnamese.
