About the program:
ASEAN–Australia Counter Trafficking (ASEAN-ACT) continues Australia’s long running collaboration with ASEAN and its member states to end human trafficking in our region. The program will principally work on strengthening the justice sector response to human trafficking, while opening up new partnerships with allied government agencies, civil society and business. It will engage all 10 ASEAN Member States in some capacity and will continue national-level programming in Cambodia, Indonesia, Lao PDR, Myanmar, the Philippines, Thailand and Vietnam.
Program Outcomes
The overarching goal that ASEAN-ACT will contribute to is that ASEAN member states have effective justice systems that provide just punishment of traffickers and protect the rights of victims. Three end-of-program outcomes (EOPOs) together contribute to the achievement of this goal by 2028:
- EOPO1: ASEAN’s planning, monitoring and reporting of ACTIP implementation is increasingly effective and advances the protection of victim rights.
- EOPO2: ASEAN member state justice and related state agencies are increasingly capable of implementing their ACTIP obligations, in particular those that uphold victim rights.
- EOPO3: ASEAN member state justice and related state agencies’ policies and practices are influenced by relevant stakeholders and better aligned with ACTIP, especially in connection to victim rights obligations.
Overview
The Vietnam National Plan of Action on Anti-Human Trafficking (NPA) 2016-2020 concludes in 2020 and the Government of Vietnam is planning to develop a new plan for 2021-2025. ASEAN–ACT will engage a technical consultant to support the Vietnamese government led by the Ministry of Public Security (MPS) to develop the next phase of the NPA that aligns with the obligation in the ASEAN Convention Against Trafficking in Persons, Especially Women and Children (ACTIP).
The NPA will guide effective implementation of Vietnam’s counter trafficking in persons efforts by prioritizing strategies that incorporate gender sensitivity and victim-centred analysis and are aligned to ACTIP obligations. The NPA is an essential tool to outline the share government agency responsibilities and coordination of action to ensure a whole of government approach.
Objective
The objective of the National Counter Trafficking Planning Consultant is to support the development of a new comprehensive NPA for Vietnam for the next five years which can be the framework for the strategic planning of government ministries in the area counter trafficking in persons. Specially the National Counter Trafficking Planning Consultant will:
- Liaise and support the multi-sectoral team led by MPS to do an assessment on the implementation of current NPA 2016-2020 and get inputs and recommendations for the development of the new NPA 2021-2025.
- In close consultation with MPS and related ministries and sectors, produce a time-bound National Plan on Anti Human Trafficking 2021-2025 aligned to ACTIP that prioritises short, medium and long-term activities, outlines specific targets, clarifies roles and responsibilities, provide a monitoring framework, and budgets and focuses on victim rights and gender/social inclusion.
- In close coordination with ASEAN-ACT Inclusion and Victim Rights Director (IVRD) and Vietnam Country Team, provide technical inputs to incorporate gender sensitive and victim-centred approaches aligned with ACTIP’s obligations into the NPA 2021-2025.
Areas of Responsibility
Under the supervision of the Country Manager – Vietnam, and in close consultation with Justice Systems Director (JSD) and Victim Rights and Inclusion Director (IVRD), the National Counter Trafficking Planning Consultant will work closely and in cooperation with the Counter Trafficking Planning Consultant (Lead) and with the MPS Multisectoral Drafting Team to:
Review National Plan of Action on Counter Trafficking in Persons 2016-2020
- Support and assist with the collation of information and resources to review of the current National Plan of Action on Counter Trafficking in Persons 2016-2020
- Support and assist with the development questionnaires to be given to government and non-government stakeholders to gather information to aid the assessment of the previous NPA.
- Aggregate the survey results on the implementation of the NPA 2016-2020 with information and data provided by recipients and assist with translation to support Vietnam National Plan of Action on TIP to get inputs for new NPA development
Develop National Plan of Action on Counter Trafficking in Persons 2021-2025
- Participate in and assist with facilitating an initial consultation workshop to gather inputs and ideas for the outline, direction and content for the new NPA 2021-2025.
- Working in conjunction with the Counter Trafficking Planning Consultant (Lead) develop and draft the new NPA with an emphasis on ACTIP alignment, victim rights and gender/social inclusion.
- Identify any potential issues for implementation of the NPA 2021-2025 and propose measures to address these.
- Participate in and assist with facilitating a national consultation workshop to get inputs and recommendations for finalization of the NPA.
- Finalise the NPA 2021-2025 based on recommendations and feedback from the national consultation workshop and to ensure that the new NPA is aligned with ACTIP and integrates victim rights/social inclusion.
Expected Outputs
The National Counter Trafficking Planning Consultant is expected to work in a team with the Lead Consultant to deliver the following outputs:
- A work plan outlining the agreed outputs, methodology and timeframe for deliverables
- Draft questionnaires for the assessment accepted by the drafting team and approved by ASEAN-ACT
- A draft format for the assessment report on the implementation of the NPA 2016-2020, for agreement
- An assessment report to ASEAN - ACT on the implementation of NPA 2016 - 2020, including its alignment to ACTIP, with specific attention given to victim rights and gender/social inclusion with recommendations gathered from stakeholders.
- Draft outline of the new NPA 2021-2025
- NPA draft for review at the national consultation workshops
- List of inputs and recommendations for the new NPA
- Final draft of the NPA for MPS to submit for approval
Selection Criteria
Qualifications and experience:
- Post Graduate qualification (or equivalent advanced university degree) in Political Science, Social Science, International Relations, International Development, Law, or relevant areas.
Required skills and experience
- Proven ability to formulate clear, succinct strategies policies, and action plans Excellent knowledge and understanding on international and ASEAN legal framework and policies relevant to trafficking in persons
- Excellent knowledge on victim-centred approach and gender sensitive within trafficking in persons nexus
- Sound understanding of the Vietnamese criminal justice and political systems.
- Proven knowledge and experience in conducting, assessing and reporting on strategic plans or similar documents.
- Ability to work with criminal justice officials and local authorities
- An excellent understanding of trafficking in persons, labour migration and social issues within the ASEAN region.
- Strong analytical, verbal, and report writing skills in English
Desirable:
- Prior experience in supporting Vietnam agencies to develop plan of action will be highly regarded
- Knowledge and experience of Australian Government development programs and reporting requirements
Reporting Requirements
- National Counter Trafficking Planning Consultant will coordinate with the Counter Trafficking Planning Consultant (Lead) and report to the Country Manager in Vietnam, provide regular updates and share expected delivery results for Country Manager review.
- The Country Manager-Vietnam and other Long-term Technical Advisors (IVRD and (JSD) will provide timely comments to the consultant’s work and address any request by the Consultant within a reasonable timeframe
- At the beginning of the assignment, the consultant team to set teamwork schedule, methodology, clear deadlines for the completion of each expected deliverable in consultation with ASEAN-ACT team based on the draft timeline.
