Project Background:

According to the situational assessment conducted by the Program during FY2020 the technical assistance needs of the six targeted provinces (Hanoi, Hai Phong, Quang Tri, Da Nang, HCMC and Dong Nai) relates mainly to areas of the Trade Facilitation Agreement (TFA) awareness raising, Special Inspection (SI), Risk Management (RM), Cross Border Management (CBM) and the utilization of the National Single Window (NSW). Specific technical assistance requests focused on the mentioned topics presented by the six local authorities and later endorsed by the PMU have been included in the Y3WP (from October 2020 to September 2021). Due to the Covid-19 pandemic, many local activities in Y3 have been carried forward to Y4 (from October 2021 to September 2022).

Activity Description:

Based on the updated TA request by HCMC Customs Department and with the approval by PMU/GDVC, in the Y4 Workplan (until September 2022), the Program will support HCMC Customs to organize training courses to improve their capacity in their professional job and duties. The 1st training course planned for February 2022 will be on Self-Certification in FTAs which Vietnam is a member. The tentative training agenda is below:

Discussion and Responses to questions of participants

 

Objectives:

  • Improve the knowledge of local customs officers in HCMC about seft-certification in FTAs recently accessed by Vietnam;
  • Indicate differences of self-certification mechanisms in FTAs recently accessed by Vietnam;
  • Provide specific examples for the application in origin definition and verification;
  • Provide all information about national legislation on self-certification and references to international practice and experience;
  • Provide answers all the questions raised by local customs officers about the subject with the view to improve their application.

Tasks & Responsibilities:

One local consultant will implement the following tasks:

  • To produce materials in the forms of PowerPoint (a must for the presentation), Words/ Excel and others on the following topics:
    • Rules and criteria to define the goods origin
    • Comparison ROOs in traditional FTAs and FTAs of new generation recently accessed by Vietnam
    • Highlighted differences in Self-Certification Mechanisms in EVFTA, UKVFTA, ATIGA, and VKFTA
    • Instruction on regulated verification of self-certification of origin   
    • Instruction on regulated verification at the production site
    • Documents to prove the origin of material inputs imported or purchased domestically
  • Provide examples, exercises and responses to questions raised at the training to improve the capacity of local customs officers in their future application

Qualifications:

Ideally, the Consultant should have:

  • Practical experience involving in the negotiation process of FTAs and drafting legislation documents relating to ROO provisions
  • Master's degree or higher in trade policy, international trade, customs law or administration, economics, business administration, or similar field
  • Minimum 15 years of experience in policy making and practical working in customs training, particularly TFA, FTAs
  • Deep understanding and experience of the FTAs accessed by Vietnam and international regulations and application on customs procedures in general
  • Good written, oral, and presentation skills in Vietnamese and English (preferable); and
  • Ability to travel within Vietnam.
